Construction Disputes, Stop Notice &#038; Mechanic\u2019s Lien Lawsuits<\/em><\/p>\n<p>After recording a Mechanic\u2019s Lien, follow the suggestions below to make sure your Mechanic\u2019s Lien is Collectible!<br \/>\n1. <strong>Act quickly.<\/strong> Do NOT procrastinate. Deadlines are critical to your ability to collect! A Mechanic\u2019s Lien binds a property for 90 days only and it expires if a lawsuit is not filed. The lawsuit foreclosing upon the Mechanic\u2019s Lien must be filed no later than 90 days after recordation of the Mechanic\u2019s Lien.<br \/>\n2. <strong>Confirm<\/strong> the information on the Mechanic\u2019s Lien is accurate. A Mechanic\u2019s Lien lawsuit will be defeated if you willfully provide a false Mechanic\u2019s Lien or include labor, services or materials not furnished for the property. A Mechanic\u2019s Lien should not include attorneys fees, lost profit, consequential or delay damages.<br \/>\n3. Determine if an <strong>additional\/successive Mechanic\u2019s Lien<\/strong> is necessary. After recording a Mechanic\u2019s Lien, you may record additional liens for the following reasons, as long as the additional recordations are within the statutory deadlines:<br \/>\na. To correct an error in the original Mechanic\u2019s Lien<br \/>\nb. To renew an expired Mechanic\u2019s Lien (only if the owner has not already expunged previously recorded but expired Mechanic\u2019s Lien)<br \/>\nc. To rectify a premature Mechanic\u2019s Lien<br \/>\nd. To assert a claim on a separate contract work<br \/>\n4. <strong>Gather key information.<\/strong><br \/>\na. Name &#038; address of project Owner\/Contractor\/Lender<br \/>\nb. Project Name\/Address\/ Assessor\u2019s Parcel Number<br \/>\nc. Project status and\/or completion date; If public project, the date project accepted<br \/>\nd. Payment bond information, if applicable<br \/>\n5. <strong>Gather important documents.<\/strong><br \/>\na. Contract Documents<br \/>\nb. Preliminary 20 Day notice, including any amended notices<br \/>\nc. Recorded Mechanic\u2019s Lien, including any amended and\/or successive liens<br \/>\nd. Mechanic\u2019s Lien release bond, if applicable<br \/>\ne. Pay Requests<br \/>\nf. Unpaid Invoices\/delivery tickets<br \/>\ng. Letters demanding payment<br \/>\nh. Conditional\/Unconditional Release and Waivers<br \/>\ni. Notice of Non-Responsibility<br \/>\nj. Notice of Completion\/Notice of Cessation\/Acceptance by public entity<br \/>\n6. <strong>If you are paid<\/strong> and the check clears the bank, you must provide a Release of Mechanic\u2019s Lien. If you receive partial payment, you must provide a Partial Release of Mechanic\u2019s Lien.<br \/>\n7. <strong>Consult with an attorney promptly<\/strong>. Mechanic\u2019s Lien claims are waived if not timely pursued! An attorney will require about a week to prepare the lawsuit and file it with the court.
