The Department of General Services (DGS) recognizes the vital role suppliers to State Government Agencies play in California’s economic recovery efforts. State government must do its part to ensure suppliers are paid accordingly. Government Code (GC) Section 927 et. seq., sets forth the California Prompt Payment Act. The Prompt Payment Act requires State agencies to pay properly submitted, undisputed invoices within 45 days of initial receipt. If the requirement is not met, State agencies must automatically calculate and pay the appropriate late payment penalties.
 
In the event a State Agency fails to make timely payment to a supplier because no Budget Act has been enacted, penalties shall continue to accrue until the time that the invoice is paid, pursuant to GC Section 927. 11(d). Suppliers may visit www.pd.dgs.ca.gov/promptpay for additional information on the Prompt Payment Act.
 
What to do if a Supplier has not been paid in a timely manner- Prior to seeking the DGS Office of Small Business and DVBE Services (OSDS) assistance with resolution on contract payment issues, Suppliers should first contact their applicable State Agency’s Accounting Office for assistance and questions regarding specific invoices submitted for payment. After doing so, if Suppliers continue to encounter difficulties receiving payment they should then consult with that State Agency’s Small Business and Disabled Veterans Business Enterprise (DVBE)  Advocate for additional assistance.  Department Advocates serve as liaisons and provide assistance to suppliers to resolve contracting and/or invoice issues and ensure payments due are made promptly as provided for in GC Section 927 et. seq. Please visit www.pd.dgs.ca.gov/smbus/advocate to view the Small Business and DVBE Advocates Directory and locate the designated State agencies’ Advocate.

Get your pen and pad of paper ready, 1099 paper that is. As part of the newly enacted Patient Protection and Affordable Care Act signed into law March 23, 2010, by President Obama, businesses will be required to report payments over $600 per year of goods or services made to anyone, including corporations, except entities exempt under 501 (a) charitys and non-profits. This will also effect you if you receive payments through credit card terminal. The credit card processing companies will be sending a new 1099 called 1099-k which will report your income received. Read more about this proposed law here.
You should start getting 1099 information as soon as possible to help aleviate being over paperworked by emailing or sending the form W-9 to all of your vendors. You can get form W-9 here.

PUBLIC NOTICE:

The Southern California Regional Rail Authority (Metrolink) is conducting a study of its contracting in Southern California. This disparity study includes experiences of business owners and whether or not there is evidence of discrimination based on race, gender or ethnicity in the transportation contracting industry.

Metrolink will review this information as it considers future implementation of the Federal Disadvantaged Business Enterprise (DBE) Program on Federal Transit Administration-funded contracts. Metrolink is conducting this study as a result of recent court decisions and guidance from the U.S. Department of Transportation.

As part of a regional approach, four additional Southern California agencies also participated in the Study: the Orange County Transportation Authority (OCTA), the San Diego Association of Governments (SANDAG), the San Diego Metropolitan Transit System (MTS), and the Los Angeles County Metropolitan Transportation Authority (Metro).

You and others at your organization have the opportunity to review a draft of the disparity study report for each agency and provide additional information as part of the study process.

Draft Disparity Study Reports

Drafts of the disparity studies for the participating agencies will be available on agency websites by September 25, 2009. The Metrolink disparity study can be found at www.metrolinktrains.com/disparitystudy.

Vendors, contractors, industry representatives and others are invited to attend a Public Forum to share personal experiences and other information relevant to Metrolink future implementation of the Federal DBE Program. This may include whether or not there is evidence of discrimination affecting the transportation contracting industry; starting and expanding businesses; obtaining financing, insurance and bonding; obtaining work with the above agencies and other local establishments; subcontracting opportunities; and the need for any assistance programs. Testimony will become part of the public record for the disparity study.

Participants in the Public Forums will have the opportunity to testify in person and/or give written testimony. Disparity Study Draft Report

CalTrans District 8, in partnership with the Department of General Services (DGS), California State University, San Bernardino and the Inland Empire Small Business Development Center, will host the Inland Empire Contracting Connections and Procurement Outreach.

You will have a chance to meet with the State government purchasing, contracting and procurement officers of District 8, who obtain bids for services and commodities essential to their operations.

Furthermore, you will be able to receive information on how to get your company certified as a Small Business or Disabled Veteran Business Enterprise by DGS.

Each State is designated a share of the stimuluspackage, and California will receive more than $80 billion in funding.

The Stimulus package is expected to provide the following for California1:

• Expect to create and/or save 396,000 jobs over the next two years

• Includes over $15 billion for health and human services and $12 billion for education programs with $3.1 billion currently available for schools to prevent teacher layoffs and protect education programs

• Includes in excess of $4 billion spent on transportation infrastructure, more than half on highways, bridges, and roads; to date, $625 million has already been directed to 57 projects generating over 11,000 jobs

• Expect up to $35 billion in tax relief, including a “Making Work Pay” tax credit of $400 for individuals and $800 for families

• Includes an additional $100 a month in unemployment benefits for individuals, as well as a 65% subsidy for COBRA health insurance coverage

• Provides a 13% increase in monthly food stamps while recipients of Social Security and Supplemental Security Income receive $250

With the national unemployment rate at 8.5%3 and California’s unemployment rate at 11.2%3, the Stimulus package is bringing funds and spending to jumpstart the state’s economy and your employment opportunities.

DVBE

Each State has stimulus money allocated to them for different things, California’s share of the stimulus package is approximately $80 Billion. A good majority of this funding is allocated towards Health & Welfare programs for our citizens. Within this allocation is maintenance, upgrades, and new construction of, streets, wastewater treatment projects, and buildings.

All grants are being funded by the Federal Government, and the money is given to the State (Departments thereof) inwhich other agencies must apply for funding through the grant process. The following are approximate values of construction related work for the period of 2008-2010 for the State of California.
